Med Sailing Adventures – Flotilla Cancellation Policy

If you need to cancel your booking, please notify us as soon as possible.This policy explains how cancellations are handled based on the timing of your request. It does not affect your statutory consumer rights.

Because yacht charters and flotilla arrangements require long-term commitments, cancellation charges cover costs and the risk that we may not be able to resell your spot. We strongly recommend comprehensive travel insurance.

Payments

·        Deposit: 50% of total cost, due at booking.

·        Balance: 50% of total cost, due 60 days before departure.

Cancellation Charges

·        More than 90 days before departure: $250 cancellation fee plus any credit card or transaction fees. The remainder of your deposit will be returned.

·        89–61 days before departure: Deposit (50% of total cost) is non-refundable.

·        60–31 days before departure: 75% of total cost is non-refundable.

·        30–0 days before departure: 100% of total cost is non-refundable.

Refunds, when applicable, are processed minus any platform, transaction, or processing fees.

Cancellations Due to Government Mandates or Events Beyond Our Control

If a flotilla must be canceled due to government restrictions, border closures, natural disasters, or other circumstances beyond our control, guests will receive a travel voucher for the full amount paid, valid toward any future Med Sailing Adventures flotilla for 12–18 months, subject to availability.

Non-Refundable Third-Party Items

Airfare, transfers, hotels, or excursions booked independently may have their own cancellation rules.

Travel Insurance Recommendation

We strongly recommend travel insurance that includes trip cancellation, medical coverage, and interruption protection.

 

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, CREW PARTICIPATION, AND MEDIA CONSENT AGREEMENT

In consideration of being allowed to participate in sailing activities organized by Whitecaps Sailing School, the ASA-certified school of Med Sailing Adventures and American Sailing, I, the undersigned, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby agree to the following:

1. Acknowledgement of Activity and Personal Responsibility

I understand that sailing is a physically and mentally demanding activity. I confirm that I am in good health and capable of participating. If at any time I feel unsafe or unfit to continue, I will notify the crew and withdraw from the activity if necessary.

I acknowledge that being at sea requires teamwork, awareness, and responsibility at all times.

2. Understanding and Acceptance of Risks

I acknowledge that sailing involves inherent risks, including, but not limited to: accidents, injury, illness (including COVID-19 or other infectious diseases), disability, drowning, or death.

These risks may result from my actions or inactions, the actions of others on board, equipment failure, weather conditions, or other unforeseen circumstances.

I voluntarily assume all such risks, whether known or unknown, and accept responsibility for personal loss, injury, or damage I may experience during this activity.

3. Release of Liability and Indemnification

I release, waive, discharge, and hold harmless the organizers of this activity—including American Sailing, Calusa Marine Charters, LLC dba Med Sailing Adventures and dba Whitecaps Sailing School, and their agents, instructors, crew, volunteers, and affiliates—from any and all liability, claims, demands, or causes of action, including those arising from their negligence, except where prohibited by law.

I further agree to indemnify and hold harmless the organizers from any legal claims, costs, or damages brought on my behalf despite this release.

4. Crew Conduct and Sailing Expectations

Sailing is both an adventure and a shared living experience. To maintain safety and a respectful atmosphere on board, all participants agree to:

·        Alcohol Use: For safety reasons, alcohol consumption is strongly discouraged while the vessel is underway. Drinks may only be enjoyed once the vessel is safely docked, anchored, or moored for the night. Impaired judgment at sea can put everyone at risk.

·        Shared Expenses (“Boat Kitty”): Each yacht maintains a shared fund to cover food, docking/mooring fees, and fuel. Participants may decide whether wine or beer is included; hard liquor should be purchased separately if desired.

·        Safety Compliance: Participants agree to follow all crew instructions regarding safety equipment, procedures, and emergency protocols.

5. Media Release and Social Sharing

I grant permission to Calusa Marine Charters, LLC dba Med Sailing Adventures and dba Whitecaps Sailing School to take photographs and video recordings of me during the trip. These images may be used for promotional purposes, including:

·        Social media (Instagram, Facebook, YouTube)

·        Website and marketing materials

·        Submission to American Sailing for editorial or promotional use

I waive any right to inspect or approve the final images or videos and understand no compensation will be provided.

6. Emergency Medical Treatment

I consent to receive emergency medical care, including first aid, transportation to medical facilities, or other necessary treatment, in the event of injury or illness while participating.

7. Travel Insurance

I acknowledge that participation in sailing activities involves inherent risks and that Med Sailing Adventures strongly recommends comprehensive travel insurance, including trip cancellation, medical coverage, and interruption protection.

8. Final Acknowledgment

I have read, understood, and voluntarily accept the terms of this agreement. I understand that I am waiving substantial legal rights and assuming responsibility for my participation.

If any part of this agreement is found invalid or unenforceable, the remaining provisions shall remain fully enforceable.

This agreement is governed by the laws of Florida, USA.

Med Sailing Adventures and Whitecaps Sailing School (“we,” “us,” or “our”) respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and safeguard your information when you visit our website or book a sailing trip.
